Civil claims and disputes are dealt with a solicitor who specialises in what is called “Civil Litigation”. Civil litigators are essentially dispute-resolvers.
Dispute-resolvers spend much of their professional lives helping their clients settle disputes through negotiation, and out of court. Once clients have asked a solicitor to instruct on their behalf, negotiation is then shaped by the legal system.
The benefit to instructing a civil litigator is that our civil lawyers will seek to maximise the value of the litigation for the client. To do so, they calculate the expected value of trial (i.e., the anticipated judgment times, and the probability it will occur, less trial costs), then compare it to any settlement offer on the table, and select whichever promises to give the client greater value / compensation. Because the costs of trial are so much greater than the costs of settlement, most companies will opt to settle their cases through negotiation.
