Case Study: Simon Baller and Bradley Smith
In 2022, Sussex homeowner Simon Baller hired Bradley Smith to carry out two building projects at his property: an annex for his mother and a garden studio room. Initial payments were made to Bradley Smith under two different company names, BipKits and Swift Modula.
While minimal work began on the annex, the garden room was never started. No foundations were dug, no materials were delivered, and no refund was issued. After being given a string of excuses and still left without progress, Simon reported Smith to the police, but no action was taken.
Refusing to accept defeat, Simon turned to Watson Woodhouse Solicitors and launched a private prosecution. With the support of solicitor James Pritchard, Smith was prosecuted for theft under section 1(1) of the Theft Act 1968, resulting in 280 hours of community service and returning the money to Simon.
