Private Prosecution Launched After Builder Fails to Deliver on Promised Work

Many of us invest in our homes hoping to create more space, comfort, and value, not expecting it to quickly turn into an unexpected legal battle. But that’s exactly what happened to Sussex homeowner, Simon Baller.

Two Projects, One Builder, Big Promises

In 2022, Simon purchased a property in Pease Pottage with the goal of creating a shared space for his family constructing annex. The search for a builder led Simon to Bradley Smith, the owner of a company called BipKits.

While construction was underway, a second project for a garden studio room was agreed. This time, Bradley issued a separate quote of £16,500 under a different business name, Swift Modular. Bradley claimed it was simply to differentiate between the two jobs.  Simon paid the initial deposit of £8,250 in August 2022, followed by a further £3,330 in September 2022 with the final balance to be paid on completion.

No Work, No Materials, No Refund

Bradley assured Simon the garden room foundations would be dug on the 12th of September 2022, but no one turned up. One excuse followed another, illness financial issues, and vague promises. But no materials were delivered, no work began on the garden room, and the annex was left unfinished.

Despite paying £11,550 toward the garden room, Simon received no refund.

Private Prosecution Against Bradley Smith

Frustrated and feeling deceived, Simon reported the matter to the police. Bradley was interviewed, but no charges were brought. Simon turned to Watson Woodhouse Solicitors and launched a private prosecution.

James Pritchard, of Watson Woodhouse Solicitors, supported Simon Baller through the legal process. Bradley Smith was charged of theft under section 1(1) of the Theft Act 1968, resulting in 280 hours of community service and an order to repay the money to Simon.
